有关阿富汗的联合声明 ——保护妇女、儿童、LGBTIQ 和其他弱势群体

我们，以下签名组织——致力于促进不同性倾向、性别认同和表达以及性别特征（SOGIESC)人群的人权保护的机构，呼吁阿富汗政府保护妇女、儿童、男女同性恋者、双性恋者、跨性别者、间性人(LGBTIQ) 和其他弱势群体的权利。
自 8 月 15 日以来，塔利班领导的军队对喀布尔总统府的接管以及阿富汗伊斯兰共和国政府的突然垮台引发了国际社会以及阿富汗国内人士对该国人权和边缘化群体安全的担忧。除了 LGBTIQ 群体和多元性倾向、性别表达和认同以及性别特征人士之外，妇女、宗教少数群体、记者和人权捍卫者也感受到了威胁，许多人因恐惧而躲藏起来。
我们对于一些报告中所指出的塔利班已经开始执行其严格版本的伊斯兰教法的情况感到关切。根据这些报道，许多妇女和女童害怕参与公共生活，同时恐惧面临再次被禁止上学及上大学的风险。看到妇女团体几十年来取得的进步可能突然和灾难性地逆转，我们感到很难过。
我们也担心 LGBTIQ 人士会被进一步定罪和迫害。因为塔利班当局最近发表声明，声称将恢复对男同性恋者的死刑判决。多年来，阿富汗 LGBTIQ 人民一直生活在对暴力和杀戮的恐惧之中，我们担心这种情况会进一步升级。
在国际LGBTI联合会（ILGA World）最新发布的《国家支持的恐同症（2020 年）报告》中，阿富汗被列为没有完全法律保护并且对双方同意的同性性行为施以死刑为既定惩罚的国家之一（详见此处）。在这份报告中，还更新了阿富汗 2017 年刑法第 646 条下“同性行为”的明确刑事定罪条款以及近年来的执法情况（详见此处）。
虽然塔利班宣布对阿富汗实行“大赦”，并呼吁妇女“根据伊斯兰教法”加入政府工作，但我们想要强调，任何形式的治理都必须基于人权框架和循证做法赋予妇女和少数族裔应有的权利。如果塔利班想要将妇女包括在内，它首先需要停止阻止妇女获得公共生活和教育，并且不继续对妇女和少数族裔造成任何伤害。
阿富汗危机复杂而艰难，但我们提醒国际社会，它有道义上的义务——尤其是那些在发展议题上发挥作用的政府和机构——确保在解决政治危机的过程中优先尊重阿富汗人民的自决权，同时保护弱势群体免受伤害和暴力。
对此我们提出一下呼吁：
我们敦促塔利班尊重阿富汗宪法、阿富汗所批准的国际公约、世界人权宣言以及国际人权规范赋予所有人的权利，无论他们的性倾向、性别认同和表达以及性别特征状态。
我们要求在各方在为平息这场政治危机所做的所有努力过程，必须让LGBTIQ人士和妇女在内的阿富汗弱势群体充分参与磋商。他们的人权绝不能因政治和平协议而受到损害。
我们呼吁国际社会向所有阿富汗人民提供紧急人道主义援助和保护。
我们敦促各国开放边界，接受来自阿富汗的难民和寻求庇护者。我们赞扬加拿大承诺接纳 20,000 名弱势阿富汗人并优先考虑 LGBTIQ 人士、女性领袖和其他群体，并期待其他国家效仿。
我们呼吁大家共同努力，按照自身的能力尽可能地为阿富汗人民提供支持。注意到在阿富汗缺乏 LGBTIQ 组织， 我们因此呼吁个人和团体进行捐款，提供紧急资金，并呼吁各方组织参与到救助资金的收集和分配过程中。
